A PEO Relationship Does Not Make FMLA Responsibility Automatic

Trion lists FMLA management and compliance among the HR services it can provide to client companies.

For employees, that means Trion may participate heavily in the leave process.

It does not mean that every employee at a Trion client is automatically eligible for FMLA or that Trion is necessarily the legally responsible primary employer in every relationship.

FMLA Has Its Own Eligibility Rules

The Department of Labor states that eligible employees of covered employers may receive job-protected unpaid leave for specified family and medical reasons with continuation of group health coverage under required conditions.

Eligibility generally depends on factors including employer coverage, length of service, hours worked, and worksite size.

A PEO relationship does not eliminate those tests.

Primary and Secondary Employer Matter

In a joint-employment situation under FMLA, the Department of Labor distinguishes a primary employer from a secondary employer.

Factors include who has authority over hiring and firing, work placement, pay, and benefits.

The primary employer generally has responsibilities for:

required FMLA notices;

providing FMLA leave;

maintaining health coverage during qualifying leave;

restoring the employee to work.

Secondary employers have separate obligations.

A PEO Is Not Automatically a Joint Employer

Department of Labor operational guidance specifically discusses PEOs.

It says a PEO merely performing administrative functions does not automatically enter a joint-employment relationship for FMLA purposes. The actual facts and degree of control matter.

That is why an employee should not determine legal responsibility solely from whose name appears on payroll.

Start With the Employer’s Leave Process

Employees needing leave should use the procedure supplied by their actual workplace.

That process may route the leave to Trion for administration.

The employee should identify:

who receives the initial request;

where medical certification is sent;

who issues eligibility/designation notices;

how benefit premiums are handled;

who manages return-to-work documentation.

Do not send medical documentation to an unrelated editorial or support website.

Medical Information Is Sensitive

Trion’s worksite employee privacy policy identifies medical and health information in contexts such as leave, accommodation, work restrictions, and correspondence with healthcare providers among information that may be processed.

Employees should use only the designated secure channel for those records.

FMLA and PTO Are Not the Same Thing

FMLA generally concerns protected leave rights under federal law.

PTO is an employer-provided paid-time mechanism subject to the employer’s policies and applicable law.

The two can interact, but a PTO balance does not by itself establish FMLA eligibility.

Similarly, an approved FMLA leave does not necessarily mean every day of leave is paid.

Benefit Coverage During FMLA Has Its Own Rules

For qualifying FMLA leave, the Department of Labor says the responsible primary employer generally must maintain group health coverage under the same conditions required by the statute.

Employees should still follow the plan’s process for any employee premium contributions required during leave.

Return to Work Can Require Coordination

Depending on the circumstances, the leave administrator, employer, healthcare provider, and employee may all participate in return-to-work processing.

The workplace needs to know whether the employee can return and whether restrictions apply.

The HR or leave administrator needs the documentation required by the applicable process.

Separate Leave Administration From the Workplace Decision

A Trion HR professional may administer leave paperwork.

The client company still operates the workplace.

The employee should therefore know who handles:

leave documentation

versus

schedule and workplace return.

That distinction prevents paperwork from being delivered to the wrong party.
